The small print (made simple)

1) Scope & acceptance

By using our site or placing an order, you agree to these Terms. If you do not agree, please do not use the site. We may update these Terms from time to time.

2) Orders & payments

• Prices are in AUD and may change without notice.
• Full or partial prepayment may be required to confirm your order.
• Payments are processed by our payment providers; we do not store full card details.
• Orders are accepted subject to availability and ingredient supply.

3) Custom cakes & proofs

For custom designs, we provide sketches or photos for approval. Final results may vary slightly due to handmade techniques and seasonal ingredients.

Minor colour/decoration variations are considered acceptable within artisanal standards.

4) Pickup & delivery

• Pickup times are confirmed when you order. Please collect on time to ensure product quality.
• Delivery windows are estimates; traffic and weather may cause delays.
• Chilled delivery is available in Barossa & Adelaide Hills (see Services).
• Once delivered or collected, storage and handling are your responsibility.

5) Changes & cancellations

• Change requests must be made as early as possible; complex custom orders may need ≥7 days’ notice.
• Deposits for custom work may be non-refundable after design approval and ingredient ordering.
• If we must cancel (e.g., unforeseen events), we will offer a refund or alternative date.

6) Allergens & dietary

We handle common allergens (e.g., nuts, dairy, gluten, eggs). While we take care, cross-contact is possible. Please inform us of dietary needs when ordering.

7) Gift cards

Gift cards (if offered) are non-refundable and valid until the printed expiry date, except as required by law.

8) Intellectual property

All content on this site (logo, text, photos) is owned by or licensed to Stayin-Day. You may not copy, distribute, or create derivative works without permission.

9) User reviews

By submitting reviews, you grant us a non-exclusive right to display and share them (edited for clarity or length) on our channels. Do not post unlawful, offensive, or misleading content.

10) Acceptable use

• No attempts to disrupt the site or bypass security.
• No automated scraping without permission.
• No unlawful or harmful use of our services.

11) Third-party links

External websites we link to are not under our control. We’re not responsible for their content or policies.

12) Disclaimers & limitation of liability

To the extent permitted by law, our services are provided “as is”. We exclude all non-mandatory warranties and are not liable for indirect or consequential losses.

Nothing in these Terms limits rights that cannot be excluded under the Australian Consumer Law (ACL).

13) Indemnity

You agree to indemnify us against losses arising from your breach of these Terms or unlawful use of the site.

14) Governing law

These Terms are governed by the laws of South Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia.
